The city of Leavenworth argued Projekt Bayern attracted visitors to its Wenatchee event by causing confusion through its use of the Leavenworth name.

Judge O. Rice ruled to dismiss Projekt Bayern for failing to amend their counterclaim until after 60 days have elapsed after the first claim was presented to court.

The city still has not provided sufficient evidence that Projekt Bayern filed a trademark under false pretenses.

If they win, Projekt Bayern is asking for the city to compensate their legal fees and to pay for any damages incurred from the trademark confusion.
