Grant County Prosecuting Attorney Garth Dano has cleared Moses Lake Police Officer Nick Stewart in an incident that killed Jose Rivera, and injured K9 Chief.

It began on the night of February 28th when officers were responding to reports of a robbery suspect.

They chased Rivera through the Cascade Valley community when his car was stopped by spike strips.

He tried to escape on foot shooting at Stewart and Chief, striking the dog in the head. Stewart returned fire, killing Rivera.

Prosecutor Dano's decision said that Stewart, "acted with the highest level of professionalism as a trained police officer."
