A Washington state Appeals Court in Spokane is upholding the conviction of an Okanogan man for the attempted murder of Gebbers Farms CEO Cass Gebbers.

Its rejected Mark Reynolds Worth’s appeal to overturn his conviction for shooting at Gebbers while both men were driving on Old Highway 97 near Brewster in 2016.

Gebbers was not hit by bullets, but was injured by flying shards of glass from the window on his driver’s side.

He drove to the Brewster Police Station, and from there was driven to a hospital by the police chief. The hospital treated Gebbers for superficial cuts and released him.

Worth appealed the verdict on a number of grounds, including insufficient evidence, but was rejected by the court.

“The evidence, viewed in the light most favorable to the State, supported the convictions of drive-by shooting and attempted murder,” the court said in its conclusion. “That is, any rational jury would have been able to conclude that the State proved those crimes beyond a reasonable doubt.”

Three Judges for the state Appeals Court in Spokane handed down their decision Tuesday.

Worth was sentenced to 25 years in 2019 for attempted first-degree murder and drive-by shooting.
